摘要

伴随数字时代的到来，以及相应技术的不断革新，互联网的高速普及，信息传递效率发生质变等多种复杂因素的影响，使得著作权法中的利益冲突变得复杂，利益倾斜也更加严重。原本著作权法中没有得到重视的默示许可制度开始慢慢的发挥作用，学者们也渐渐意识到在知识产权法，尤其是隶属于知识产权法的著作权法中，默示许可制度承担了不可代替的作用。我们有必要将散落于其它各个类别法律中的著作权法默示许可制度重新归纳，总结，并整理到著作权法之中，以便能够合理，规范，有效的运用于司法实践中从而使著作权法的功能更加完善，以便能够调和更加复杂的利益冲突，进一步的平衡版权人与社会公众的利益。从而在保护版权人利益的同时，促进文学、艺术与科学知识的繁荣与发展，又能兼顾保障社会公众利益。

Abstract

  With the advent of the digital age, and the corresponding technical innovation and the rapid spread of the Internet, information transmission efficiency of qualitative change and so on many kinds of complex factors, need to pick the conflicts of interests become complex in the copyright law, tilt interests became more and more serious. Originally in copyright law did not get the attention of implied license system began slowly to play a role, scholars also became aware of in the intellectual property law, especially belonging to intellectual property law, copyright law, implied license system assumed the role can not be replaced. It is necessary for us to put copyright law on the right of implied license which was scattered in each of the other categories of laws in order , summary, and organize them into copyright law to reasonable, specification and effective use in judicial practice so that the function of copyright law more perfect, in order to be able to reconcile the conflicts of interest more complex, further balance of copyright between owners and the public interest. In order to protect the interests of the copyright owners, while promoting the prosperity and development of literature, art and science knowledge, and can take into account the protection of the public interest
