在城中村拆迁改造背景下，农村家庭内部宅基地财产分配问题应当受到重视。本文基于河南省7户城中村拆迁家庭纠纷案例，提出宅基地使用权的物权变动方式在置换为拆迁安置房后转变为所有权，但其之间存在联系。这种转变的特有形式决定了回迁安置房不是简单的所有权，与一般房屋所有权有所区分，在转变过程中应当依照房地分离主义专门考虑宅基地财产的分配方式。本文重构了在城中村拆迁过程中的“人”“户”“家”关系，肯定农村成员依其身份应当公平享有宅基地财产，在比较了现有的城中村拆迁安置过程中宅基地财产的分配模式后，提出应当在“家庭关系”中基于平等的成员身份进行宅基地财产均等分配，保障城中村拆迁改造长期有序进行。

Under the background of demolition and transformation of urban villages, the issue of the distribution of homestead property within rural families should be paid attention. Based on the disputes of family demolition in 7 villages in Henan Province, this paper proposes that the change of property rights of the right to use the house site will be transformed into ownership after being replaced by the demolition and resettlement house, but there is a link between them. The form of this transformation determines that the resettlement house is not a simple ownership, and is different from the general house ownership. In the process of transformation, the distribution method of the homestead property should be specifically considered according to the real estate separatism. This paper reconstructs the relationship among “villager”, “household” and “family” in the process of demolition in urban villages. It is affirmed that rural members should enjoy the property of homesteads according to their identity. In comparison with the existing house demolition and resettlement process, it is proposed that the "family relationship" should be based on equal membership to carry out the equal distribution of homestead property, so as to ensure the long-term and orderly implementation of the demolition and transformation of the village.
